Terms of Service * Welcome to JFS! Dear client, Welcome to the JFS family! My name is Jennifer Nguyen and I am the founder of JFS. I built this company after working at several big banks and earning my position as number one banker in San Diego, then California, then one of the top Private Client Bankers in the United States. Throughout this journey of working with several banks and in different demographics, I have learned the ins and outs of the banking industry. During my final year of working at the bank and being one of their best Private Bankers in the nation, I suffered family loss and heart issues at the age of 29. I realized that life is too short to live an ordinary life, so I quit the bank exactly a month before I turned 30 years old to travel the world! I guess life never turns out the way you want it to. I quit my job right before COVID started and got stuck overseas. During my time traveling overseas, every single day I received requests from people, some are friends, some I don’t know of, some are clients from the past that have been following me from one bank to another asking me to help them with their finance. Then one day it hits me! Finance is my life career and no matter what financial goals one has, it always starts with credit! Finding my way back to the US during COVID, I launched JFS in May 2020. My brother Khoa Nguyen who works as a software engineer at big technology companies later joined my mission to bring the best experience possible to our clients, using our banking, finance, and advanced technology skill set! I now help people to take the power back from the banks and bureaus after learning their ins and outs. I have helped many people just like you to correct and improve their credit reports using my knowledge and experience. When you hire us, we will fight for you with not only the three major credit bureaus but also the creditors and collection agencies if needed. We will relentlessly audit and demand verification on accounts which are inaccurate and work towards resolutions for accounts that are deemed accurate. This program is a full service program, with full support and transparency. I am extremely confident that you will be very happy with the results; however, be aware, this is not a miracle cure. We do not guarantee that you will have perfect credit, nor do we guarantee that any specific item on your credit report will just “go away”; but we promise to work hard and do everything within our power to help you reach your goals. This Service Agreement (“Contract”) is made in the State of California and constitutes the complete understanding between you and JFS (the “Representation”). I. DEFINITIONS A. Bureaus. The term “Bureaus” shall mean, collectively or individually, the major credit bureaus (TransUnion, Equifax, and Experian). B. Credit Repair Communications. The term “Credit Repair Communications'' shall mean written or electronic communications to Bureaus and/or Furnishers. Credit Repair Communications will be sent in accordance with your instructions and information as well as JFS’s analysis of your credit reports. C. Content. The term “Content” shall mean JFS’s works of authorships, including but not limited to its registered marks, copyrighted material, any revisions, modifications and enhancements thereto, and any trade dress. D. Furnishers. The term “Furnishers” shall mean one or more credit report information furnishers (for example, creditors, debt collectors, and banks). E. Service Interval. The term “Service Interval” shall mean 5-15 days after the date of this Contract, and monthly thereafter or the date Representation ends, if earlier. F. Service Interval Trimester. The term “Service Interval Trimester” shall mean four consecutive Service Intervals. G. Websites. The term “Websites” shall mean the website located at www.jennfinancialsolutions.com and such other sites as JFS may choose to operate in connection with the Representation. II. SERVICES AND REPRESENTATION You are engaging the service level (described below) as of the date of this Contract. You may change your service level at any time simply by contacting JFS. In the event you change your service level, all terms and conditions of this Contract will apply to your chosen service level. You agree that, by signing this Contract, you are providing JFS with “written instructions” in accordance with the Fair Credit Reporting Act to periodically obtain your credit reports from any consumer reporting agency, affiliate or third party and to use your credit reports to provide you with the services agreed to as part of this Contract. Subsequently, JFS typically performs one or more of the following ongoing and periodic services as appropriate in its judgment and discretion: receives and reviews Bureau and Furnisher correspondence sent to us directly or by you; collects and reviews updated information and instructions from you regarding your circumstances, goals, and case; monitors and analyzes your case; provides you with status updates regarding your case; and prepares and sends one or more additional Credit Repair Communications on your behalf. JFS cannot guarantee and you are not paying for a particular credit report outcome or result; you are paying only for JFS’s efforts on your behalf. The Bureaus or Furnishers may not respond to initial or subsequent Credit Repair Communications and ultimately may decide not to remove items from your consumer credit files despite JFS’s efforts. JFS’s Representation is designed to assist you in your efforts to ensure that your credit reports fairly and accurately reflect your credit history, and to provide you with valuable guidance as you continue to manage your credit. In order to meet your precise needs, JFS offers the following service that may assist you in your efforts to stay on track. JFS uses its judgment and discretion to determine the content, number and frequency of the Credit Repair Communications. It is your full responsibility to download, print, and mail the attack letters to the bureaus, creditors, collection agencies, and/or related parties in a timely manner in the process of fixing your credit. We will assist you in requesting that Bureaus and Furnishers demonstrate their compliance with various laws governing fair, accurate, and substantiated consumer credit reporting. Based upon its analysis of your credit reports and the information and instructions you provide, JFS will prepare the attack letters for you to send Credit Repair Communications to Bureaus. III. PAYMENT AND FEES Fees are collected on a recurring monthly basis from the debit/credit card that you put on file with JFS. This is an Agreement for the __DIY___ Package A Service Interval fee of $49.00 is charged on or about the same day of each month until you cancel the subscription of the service JFS provides. In the event that you file a chargeback on a service fee that JFS have earned and charged you according to this contract, JFS has the right to discontinue servicing you unless you pay for all owed debt to JFS plus any chargeback fees. You authorize JFS to substitute additional payment methods provided by you in the event any fee or charge authorized by this Contract is not honored upon first presentation by JFS. You grant JFS permission to withdraw any fee or charge authorized by this Contract from your credit or debit card or bank account and to verify your account information. While the amount of work performed may vary from Service Interval to Service Interval, your monthly fee for additionally elected Service Intervals will remain the same. IV. TERM AND CANCELLATION This is a month to month contract between you as the client and Jenn Financial Solutions (JFS), in which JFS will provide educational financial information as well as helping you generate attack letters. It is your full responsibility to execute the educational information and mail out the letters to the bureaus and the Data Furnishers in a timely manner in order to achieve the maximum potential desired outcome. You may suspend or cancel this Contract at any time and in a number of ways, including: (a) signing and mailing JFS one of the Notices of Cancellation, or (b) sending JFS a written request. JFS honors all cancellation requests without condition or charge that are sent to JFS within the first three days of the date of this Contract. It may take up to three business days from the day JFS receives your request to process it. Cancellation requests sent after the first three days may result in a charge. The length of time you may wish to engage JFS will likely depend on a variety of factors, such as: your individual credit goals, your timely participation, the complexity of your case (e.g. the type and number of unfairly or inaccurately reported credit information subject to substantiation), initial and subsequent positions taken by a particular Furnisher or Bureau regarding an affected credit report item, new information added to your credit profile during your Representation, changes to your initial credit goals, and other related factors. You are advised to review your case at least each month and determine whether you wish to continue JFS’s Representation or suspend or cancel it. JFS reserves the right to withdraw from working on your file if you breach this Contract or for any reason permitted under applicable professional rules of conduct. In the event JFS withdraws, you agree to pay JFS for the services rendered by JFS previous to the date of withdrawal. JFS may have discussions with you regarding your case and in doing so may provide its opinion, in its judgment, regarding your options and possible outcomes, given the information you provide to JFS. Any expressions of opinion may not reflect an actual outcome. V. CLIENT RESPONSIBILITIES AND COMMUNICATIONS You agree to assist JFS in answering certain security questions regarding your identity and credit history as may be necessary to obtain your credit reports. You agree to choose on your own, which credit report items to send the challenge to the Bureaus and Data Furnishers. You will provide JFS with legible copies (not originals) of updated credit reports at least every thirty days, OR access to online credit monitoring. You understand and acknowledge that failure to update credit reports or mail out attack letters in a timely manner as well as not executing the educational information learned from JFS DIY credit repair program may delay or negatively impact your case. You agree to send only copies of documents, not originals, for JFS to scan, store electronically, and shred. You agree to promptly inform JFS if your contact or payment information changes. You agree to review your case each month and determine whether you wish to suspend or cancel the Representation. Once Representation is canceled, you authorize JFS to destroy your file in accordance with JFS’s retention policy, excluding only those documents which are required to be retained. You may request copies of your file for up to 24 months as required under the Credit Services Act. You agree and acknowledge that JFS may communicate private and confidential information with you via unencrypted email at the address you provide. You agree to promptly inform JFS if your email address changes by calling JFS. You agree that all information you provide JFS is true to the best of your knowledge. You understand and acknowledge that you are not paying for, and that JFS does not make, any representation, warranty, promise or guarantee as to any particular outcome or result. You are paying only for JFS’s work. The Bureaus or Furnishers may decide not to remove items from your consumer credit files despite JFS’s actions. You understand and acknowledge that your credit score might go down in certain situations when negative items on your consumer credit report get removed. You understand and acknowledge that removing negative information from your credit report alone is not enough to improve your overall credit situation. You acknowledge that you intentionally hired JFS, which is based in the state of California to represent you as described in this Contract. You acknowledge that Credit Repair Communications prepared by JFS may include your account number(s) and Social Security Number in order to reference your account. You understand Credit Repair Communications sent by JFS to Furnishers and Bureaus on your behalf will be sent in your name, and will not be identified as being sent by JFS. Copies of written Credit Repair Communications will be provided to you upon request. You agree to all other terms and conditions within this Contract. VI. JFS WILL NOT DO ANY OF THE FOLLOWING: JFS will not file your case in court or perform pre-litigation services on your behalf. JFS assists you in contacting Bureaus and Furnishers to address items on your credit reports, but JFS does not promise or provide any specific outcome with regard to your credit history or credit report. Multiple attempts to assist you in this effort may be necessary, and should you deem JFS’s actions to be unsuccessful, you may need to seek outside legal representation regarding a particular Furnisher or Bureau. JFS will not dispute accurate information within your credit report. VII. STAFFING JFS may assign various staff, or others to perform work on your case. You agree services in connection with your Representation may be performed by any staff member or contractor that is associated with JFS, and any such staff or other assistants. There is no additional charge to you for work performed by these individuals. VIII. GENERAL A. ARBITRATION. You agree to arbitrate all disputes and claims between you and JFS on an individual basis only and not as a part of any class. You agree that, by entering into this Contract, you are waiving all rights to: (a) a trial by jury; (b) participate in a class action lawsuit or class action arbitration; and (c) bring an action against JFS in a court of law. You may individually arbitrate any claim against JFS in any jurisdiction in the United States. The rules of the American Arbitration Association shall govern the arbitration. B. SEVERABILITY. In the event that any provision or covenant of this Contract shall be held invalid, illegal or unenforceable by a court or arbitrator of competent jurisdiction for any reason, then such provision will be severed and replaced with a new provision that most closely reflects the original intention of the parties, and this Contract and all of its remaining provisions shall remain in full force and effect for the greatest time period and for the broadest scope permitted by applicable law. You understand and agree that your obligations under Sections III, V, and VIII, and any other provision which by its nature should survive termination, shall survive and remain enforceable after termination of this Contract for any reason without restriction or limit. C. CONFLICTS IN TERMS. In the event of a conflict between any notice, policy, disclaimer or other term contained in the Websites or otherwise, the terms and conditions of this Contract shall control. D. FORCE MAJEURE. JFS shall not be liable by reason of any failure or delay in the performance of its obligations hereunder due to any reason beyond its reasonable control. E. COPYRIGHTS AND TRADEMARKS. You acknowledge and agree that the Content is the property of JFS or its licensors and suppliers and may be protected by federal, state, and international copyrights laws, including the common law. Any other Content not owned by JFS that appears on the Websites is the property of its respective owner(s). All software used on the Websites is the property of JFS or its software suppliers and is also protected by federal, state, and international copyright law, including the common law. Reproduction of such Content, in whole or in part, is prohibited without prior consent. F. PRIVACY NOTICE. Your telephone calls may be recorded and monitored for quality assurance. JFS may use your personal information to the extent necessary for your Representation and as allowed by JFS’s privacy policy located online at www.jennfinancialsolutions.com, it’s terms of use located online www.jennfinancialsolutions.com. You may also request a copy of JFS’s privacy policy and terms of use by calling JFS. By executing this Contract, you acknowledge you have reviewed and agreed to JFS’s privacy policy and terms of use. To the extent JFS’s privacy policy or terms of use conflict with this Contract, this Contract shall control. JFS will not sell your information to third parties. G. REMARKETING. Once you sign this agreement, you further agree to allow JFS to telephonically call and digitally communicate regarding re-marketing and/or sales calls for other products and services. H. ASSIGNMENT / RIGHT TO SELL. JFS will have the right at all times to assign any of its rights, obligations or agreement. I. ENTIRE AGREEMENT. This Contract is the entire agreement between you and JFS and supersedes all other agreements, whether made orally or in writing. IX. LIMITED DESIGNATION OF AGENCY You agree that JFS may act as your non-exclusive agent in fact, on your behalf, for the limited purposes of: (a) requesting and receiving your consumer credit disclosures and credit reports; (b) disputing, challenging, or investigating with Bureaus as applicable, at your direction and within our professional judgment, inaccurate, unfairly reported, incomplete, or unsubstantiated information on such disclosures and reports; (c) receiving results from such inquiries and communicating them to you; (d) investigating and/or verifying information provided by Furnishers to Bureaus; and (e) signing letters on your behalf and in your name. You authorize the Bureaus and Furnishers to provide such disclosures and reinvestigation results to JFS on your behalf. You further agree that you will not knowingly dispute accurate information on your credit report or disclosures. I have received and had the opportunity to review the JFS Service Agreement, which I understand is a binding contract, and agree to all its terms and conditions. By providing your electronic signature, you engage JFS to work on your behalf and you agree to the following: You acknowledge that you have received and agree to the terms of JFS’s E-SIGN Agreement, and that you have received and have had an opportunity to review a copy of the JFS federal and state disclosure statements and notices of cancellation. JFS provides you THREE DAYS from the date of this Contract to cancel without penalty or obligation. Required Notice Under Federal Law: You may cancel this contract without penalty or obligation at any time before midnight of the 3rd business day after the date on which you signed the contract. See the attached notice of cancellation form for an explanation of this right Notice to Buyer for California Residents: You have the right to proceed against JFS’s surety bond. SureTec Insurance Company, 2103 CityWest Boulevard, Suite 1300, Houston, TX 77042 Bond Number: 5286715 Required Disclosure for California Residents: You, the buyer, may cancel this contract at any time prior to midnight of the third business day after the date this contract is signed. See the attached notice of cancellation form for an explanation of this right. Required Disclosure for California Residents: You, the consumer, have the right to review any file maintained by any consumer reporting agency, and the right of the consumer to receive a copy of a consumer report containing all information in that file as provided under the Federal Fair Credit Reporting Act (15 U.S.C. § 1681g) Required Disclosure for California Residents: You, the consumer have the right to a copy of your consumer report containing all information and the file will be furnished free of charge by the consumer reporting agency if requested by you within 30 days of receiving a notice of a denial of credit as provided under the Federal Fair Credit Reporting Act (15 U.S.C. § 1681j) A nominal charge may be imposed by the consumer reporting agency for a copy of the consumer report containing all information in your file, if you have not been denied credit within 30 days from receipt of your request. Required Disclosure for California Residents: You, the consumer, have the right to dispute the completeness or accuracy of any item contained in any file that is maintained by any consumer reporting agency, as provided under the Federal Fair Credit Reporting Act (15 U.S.C. § 1681i) Required Disclosure for California Residents: IMPORTANT NOTICE: YOU HAVE NO OBLIGATION TO PAY ANY FEES OR CHARGES UNTIL ALL SERVICES HAVE BEEN PERFORMED COMPLETELY FOR YOU, UNLESS YOU ENTER INTO A SUBSCRIPTION AGREEMENT REQUIRING PERIODIC PAYMENTS IN CONSIDERATION FOR ONGOING SERVICES. You acknowledge that you have received and had the opportunity to review the JFS Service Agreement, which you understand is a binding contract, and agree to all its terms and conditions. ELECTRONIC SIGNATURE AGREEMENT E-SIGN DISCLOSURE Your electronic signature signifies your agreement to transact business electronically, which includes receiving all documents in HTML or PDF format and communicating over the Internet. You also certify that you are at least 18 years of age and have access to the Internet to receive JFS services and to view, print, and retain all documentation. You may receive paper copies by calling (619) 514-4494 at no charge. Though you may withdraw your consent to electronically transact business with JFS by calling (619) 514-4494, by doing so, JFS will no longer be able to provide you services. I acknowledge that I have received and agree to these terms. REQUIRED FEDERAL DISCLOSURE STATEMENT Consumer Credit File Rights Under State and Federal Law You have a right to dispute inaccurate information in your credit report by contacting the credit bureau directly. However, neither you nor any "credit repair" company or credit repair organization has the right to have accurate, current, and verifiable information removed from your credit report. The credit bureau must remove accurate, negative information from your report only if it is over 7 years old. Bankruptcy information can be reported for 10 years. You have a right to obtain a copy of your credit report from a credit bureau. You may be charged a reasonable fee. There is no fee, however, if you have been turned down for credit, employment, insurance, or a rental dwelling because of information in your credit report within the preceding 60 days. The credit bureau must provide someone to help you interpret the information in your credit file. You are entitled to receive a free copy of your credit report if you are unemployed and intend to apply for employment in the next 60 days, if you are a recipient of public welfare assistance, or if you have reason to believe that there is inaccurate information in your credit report due to fraud. You have a right to sue a credit repair organization that violates the Credit Repair Organization Act. This law prohibits deceptive practices by credit repair organizations. You have the right to cancel your contract with any credit repair organization for any reason within 3 business days from the date you signed it. Credit bureaus are required to follow reasonable procedures to ensure that the information they report is accurate. However, mistakes may occur. You may, on your own, notify a credit bureau in writing that you dispute the accuracy of information in your credit file. The credit bureau must then reinvestigate and modify or remove inaccurate or incomplete information. The credit bureau may not charge any fee for this service. Any pertinent information and copies of all documents you have concerning an error should be given to the credit bureau. If the credit bureau's reinvestigation does not resolve the dispute to your satisfaction, you may send a brief statement to the credit bureau, to be kept in your file, explaining why you think the record is inaccurate. The credit bureau must include a summary of your statement about disputed information with any report it issues about you. The Federal Trade Commission regulates credit bureaus and credit repair organizations.
